1. SCOPE OF APPLICATION
Stadtlandkind GmbH, based in St. Gallen (hereinafter referred to as Stadtlandkind), is an online retailer of children's fashion and accessories with a sense of design, quality and sustainability. These General Terms and Conditions apply to all orders placed on the website www.stadtlandkind.ch in the version valid at the time of the order.

2. ORDER AND CONCLUSION OF CONTRACT
You place an online order in the store. The order is binding once you have agreed to the GTC and clicked the "Buy now for a fee" button. This creates a legally valid purchase contract. After receiving your order, you will receive an order confirmation from us by e-mail.

3. OUR DELIVERY AND SALES CONDITIONS
After confirming your order, we will send the items you have ordered to the delivery address you have specified in the form of a nicely presented parcel. The usual delivery time is 3-5 working days for Economy and 1-2 working days for Priority. For products from external shipping partners, the delivery time is delayed by 1-2 days.

If the delivery of the goods fails despite several delivery attempts, Stadtlandkind can withdraw from the contract.

Since January 1, 2020, we have been shipping all deliveries and returns within Switzerland in a climate-neutral manner. With this voluntary additional contribution, the CO2 emissions of a delivery are offset or neutralized by planting a tree or investing in alternative and environmentally friendly means of transport. The compensation payments for this ecological surcharge are covered by Stadtlandkind.

4. OFFER
Our online offer is subject to change and non-binding. As a rule, the items offered in the online store are available. If it is not possible to deliver one or more items due to a stock shortage, Stadtlandkind will inform you as soon as possible and offer you equivalent items. If you do not like any of these items, the amount will be refunded or reimbursed in the form of a voucher.

5. PRICES
Our sales prices are quoted in Swiss francs incl. VAT and excl. shipping costs.

6. YOUR PURCHASE ACCOUNT
For orders in our online store, you can use the payment options listed there. When you make your first purchase on account, we will open a purchase account for you - subject to a positive credit check - which will then be used to process all purchases, payments and credit notes on an ongoing basis.

7. DELIVERY AND SHIPPING
7.1 SCOPE OF APPLICATION
We only ship within Switzerland and the Principality of Liechtenstein.

7.2 SHIPPING COSTS
For our delivery within Switzerland and the Principality of Liechtenstein, you pay a shipping fee of CHF 8.00 (Economy) or CHF 9.50 (Priority). There are no shipping costs for voucher orders or orders with a value of CHF 150.00.

The shipping costs are a mixture of all parcel sizes up to 30 KG. Depending on the size of the items, a kickbag or the appropriate cardboard box is used, as well as the necessary franking. The amount charged is made up of the actual postage costs, packaging, shipping material, commissioning, CO2 compensation and postage.

8. PAYMENT OPTIONS
For orders within Switzerland and the Principality of Liechtenstein, the following payment methods are available: invoice, credit card, TWINT, PayPal, Google Pay, Apple Pay and Postfinance. Orders from abroad can only be paid for by credit card, PayPal, Google Pay or Apple Pay and sent to a Swiss delivery address (specify the country "Switzerland" in the billing address).

8.1 INVOICE
If you order on account, the invoice will be sent to you by e-mail and, in the case of stock items, also by post. The invoice is due within 14 days of receipt of the goods. You can pay the invoice within this period conveniently without cash by post or bank transfer. No additional fee is charged for purchases on account.

8.2 E-PAYMENT You can also pay for your order by PostFinance Card/PostFinance e-finance, by credit card, by TWINT, by Apple Pay, Google Pay or by PayPal via the secure payment system SFAERPAY (SIX MULTIPAY). All fees are borne by Stadtlandkind.

8.3 LATE PAYMENT
In the event of late payment, we charge a fee of CHF 15.00 from the 3rd reminder level. The 3rd reminder will be sent by post. In the event of late payment, Stadtlandkind is also entitled to assign the claim and costs for the debtor to third parties. The right to claim further damages remains reserved.

9. GIFT VOUCHER
Gift vouchers are vouchers that you can purchase. You can pay for your order with a voucher from Standlandkind. To do this, enter the code on the voucher in the corresponding field of the order. A gift voucher can only be redeemed before completing the order process and for the full amount.

The amount of the voucher is fixed. Gift vouchers are issued exclusively in CHF and are freely transferable.

Cash payment is excluded.

10. PROMOTIONAL VOUCHERS
Promotional vouchers are vouchers that cannot be purchased, but which we issue as part of advertising campaigns. Promotional vouchers can only be redeemed under the conditions stated therein, by the respective recipient, during the specified period and only once per person. Individual products may be excluded from voucher campaigns.

Promotional vouchers can be redeemed from a minimum order value of CHF 30; the value of the goods must in any case be at least equal to the amount of the promotional voucher. Any difference to a higher value of goods must be settled using the payment options offered. Promotional vouchers are neither paid out in cash nor do they bear interest.

A refund or re-delivery of promotional vouchers in the event of partial or complete return of the ordered products is excluded. Promotional vouchers can only be redeemed before the order process is completed. Subsequent crediting is not possible. The promotional voucher is non-transferable and may not be combined with other promotional vouchers. If you have used a promotional voucher for your purchase, we reserve the right to charge you the original price of the goods you are keeping if - due to your withdrawal - the total value of the order falls below the value of the promotional voucher.

11. RETENTION OF TITLE
The ordered goods remain the property of Stadtlandkind until full payment has been received.

12. RIGHT OF WITHDRAWAL/RIGHT OF RETURN
You can cancel the contract within 14 days of receipt of the goods by returning the goods with a description of the reason for the return. The return of the goods is at your responsibility and expense.

Only items that are absolutely undamaged and in perfect, unworn condition will be accepted for return. The items must be returned in their original, unadhesive and undamaged packaging. In particular, worn, soiled, damaged or badly smelling products cannot be returned. Should this be the case, we reserve the right to assert claims for compensation.

The amount of a return item can be deducted from the total amount. If the total amount has already been transferred to Stadtlandkind, you can choose between a voucher or a refund. The shipping costs and any CO2 compensation will not be refunded.

13. DELIVERY DEFECTS
We ask you to check the delivered items immediately for correctness, completeness and intactness. Complaints about the scope of delivery, material defects, incorrect deliveries and quantity deviations must be reported in writing by e-mail with a photo within 5 working days of receipt of the goods. The defect will be checked by Stadtlandkind immediately. If the defect is accepted by Stadtlandkind, you will receive an identical replacement item, if in stock. The costs for the return shipment will be borne by Stadtlandkind in this case.

14. WARRANTIES
The warranties of the articles purchased from Stadtlandkind are limited to the assurances of the respective manufacturer. In the event of improper liability or personal intervention, all claims shall cease.

15. DATA PROTECTION
The protection of your personal data is very important to us. We observe the applicable data protection regulations and secure your data against unauthorized access by third parties (data security precautions).

Our online store is encrypted using SSL (Secure Socket Layer), which means that all data relating to the offer as well as your payment and customer data are transmitted securely to us.

Stadtlandkind is entitled to use your personal data to send you special offers or information about new collections. You can revoke your consent to the use of your personal data for advertising purposes at any time by sending an e-mail to info@stadtlandkind.ch.

We use technical and organizational measures to secure our website and other systems against loss, destruction, access, modification or dissemination of your data by unauthorized persons. Access to your purchase account is only possible after entering your personal password.

For the purpose of a credit check, we retrieve creditworthiness information on the basis of mathematical-statistical procedures from Creditreform Switzerland, Teufener Strasse 36, 9001 St. Gallen, Switzerland. Stadtlandkind is authorized to use your personal data for this purpose.

This website contains a Facebook button and a WhatsApp button. By activating the button, you enter into direct contact with the social network Facebook (Meta) or WhatsApp (Meta). Meta uses personal data of its users in a manner that may not comply with data protection regulations, as insufficient information is provided about the use of the data. Stadtlandkind is not liable for any damage you may suffer as a result of the misuse of your personal data by Meta (Facebook, Instagram, WhatsApp).

16. APPLICABLE LAW AND PLACE OF JURISDICTION
The contractual relationship between you and Stadtlandkind is subject to Swiss substantive law, excluding the United Nations Convention on Contracts for the International Sale of Goods of April 11, 1980 (UN Sales Convention). The place of jurisdiction for all disputes is St. Gallen. Stadtlandkind is also entitled to appeal to the court at the customer's domicile/place of residence.
